3. APPLICABLE PRIVACY AND DATA PROTECTION LAW

AYKA processes personal information in accordance with applicable Indian laws relating to privacy, data protection, information technology, consumer protection and electronic commerce, as applicable from time to time. This includes, where and to the extent applicable, the Digital Personal Data Protection Act, 2023, the rules, regulations, notifications, directions and amendments issued under or in connection with it, including provisions that become applicable to AYKA from time to time.

Where other applicable laws impose obligations relating to taxation, accounting, payments, fraud prevention, consumer protection, legal proceedings, regulatory compliance or record retention, AYKA may collect, retain and process information to the extent reasonably necessary to comply with such obligations.

If any provision of this Privacy Policy conflicts with a mandatory requirement of applicable law, the mandatory legal requirement shall prevail to the extent of such conflict.

4. INFORMATION WE COLLECT

AYKA may collect and process different categories of personal information depending on how you interact with the Website and our services. Such information may include information that you voluntarily provide to us, information generated through your transactions and interactions with us, information received from authorised service providers, and technical or usage information collected automatically through your interaction with the Website.

The information we collect may include your full name, mobile number, email address, billing address, shipping or delivery address, house or flat number, building or society name, locality, road or street, landmark, city, state, PIN code, account information, login credentials, GSTIN and business information where applicable, customer support information, return, exchange, cancellation or refund information, reviews, ratings, photographs, videos, testimonials, feedback, communications with AYKA and other information that you voluntarily provide.

5. ACCOUNT INFORMATION

If you create an AYKA account, we may process information associated with that account, including your name, email address, mobile number, account credentials, saved addresses, order history, wishlist information, account preferences, customer service history and other information reasonably associated with your account.

You are responsible for maintaining the confidentiality of your account credentials and for notifying AYKA promptly if you believe that your account has been compromised or accessed without authorisation.

6. ORDER AND TRANSACTION INFORMATION

When you place or attempt to place an order, AYKA may process information relating to the transaction, including your Order ID, products purchased, quantities, product variants, product prices, order value, billing information, shipping information, delivery information, payment status, transaction references, coupon or discount information, cancellation information, return information, exchange information, refund information, warranty claims and communications relating to the transaction.

This information may be processed for order fulfilment, customer support, payment reconciliation, fraud prevention, returns, refunds, warranty administration, accounting, taxation, legal compliance and other purposes reasonably connected with the transaction.

7. PAYMENT INFORMATION

Payments made through AYKA may be processed through third-party payment gateways, payment aggregators, acquiring banks, checkout providers and other authorised payment service providers.

AYKA may receive limited payment-related information necessary to confirm payment, identify a transaction, process an order, reconcile payments, process refunds, investigate payment issues, prevent fraud and maintain transaction records. Such information may include payment status, transaction ID or reference number, payment method, masked payment information, UPI-related transaction references, payment provider identifiers and other transaction-related information made available to AYKA by the applicable payment or checkout service provider.

AYKA does not ordinarily store complete card numbers, CVV numbers, UPI PINs, banking passwords or other complete payment credentials on its own systems where such information is handled directly by an authorised payment service provider. Payment service providers may independently process payment information in accordance with their own privacy policies, security practices and applicable legal and regulatory obligations.

8. GOKWIK AND CHECKOUT SERVICES

AYKA may use GoKwik Commerce Solutions Private Limited (“GoKwik”) and other authorised checkout, technology and transaction-support providers to facilitate checkout, customer verification, COD verification, fraud prevention, order processing, payment-related technology, transaction communication and related services.

Where GoKwik or another checkout technology provider processes personal information in connection with your interaction with AYKA, relevant information may be shared with that provider to the extent reasonably necessary for the provision of the applicable checkout or technology service and for permitted transaction, fraud-prevention, security and operational purposes.

GoKwik is a technology and checkout service provider and does not itself act as AYKA's payment aggregator or payment gateway for the custody or settlement of merchant or consumer funds. Actual payment processing, fund custody and settlement, where applicable, may be performed by the relevant RBI-regulated payment aggregator, payment gateway, acquiring bank or other authorised payment service provider. GoKwik

GoKwik and other third-party providers may independently process personal information under their own privacy policies, terms and applicable laws. Customers should review the relevant third-party policies where appropriate. GoKwik's own privacy policy states that its checkout platform may process information such as name, contact details, billing and delivery information, transaction information and technical or behavioural information for checkout, transaction, support, fraud-prevention and related purposes. GoKwik

Depending on your browser, device and applicable law, you may be able to control or disable certain cookies and similar technologies through your browser or device settings. Disabling certain technologies may affect Website functionality. Where applicable law requires consent for non-essential cookies or similar technologies, AYKA will provide an appropriate consent or preference mechanism.

11. HOW WE USE PERSONAL INFORMATION

AYKA may process personal information for purposes reasonably necessary to provide products and services, process and fulfil orders, confirm transactions, arrange delivery, process payments, issue invoices, manage GST and tax requirements, administer returns and exchanges, process cancellations and refunds, administer warranties and provide transaction-related customer support.

AYKA may also process personal information to respond to customer enquiries, investigate complaints, resolve order issues, communicate regarding returns and refunds, investigate delivery issues, verify claims, communicate through phone, email, WhatsApp or other permitted channels and maintain customer-service records.

Where applicable law requires consent for a particular processing activity, AYKA will obtain consent through an appropriate mechanism. Where processing is based on consent and applicable law provides a right to withdraw such consent, you may withdraw consent through the mechanism made available by AYKA.

Withdrawal of consent does not affect processing that occurred lawfully before withdrawal and does not prevent AYKA from continuing processing where another lawful basis or legal requirement permits or requires such processing.

15. HOW WE SHARE PERSONAL INFORMATION

AYKA may share personal information where reasonably necessary to operate its business, provide products and services, process transactions, deliver orders, prevent fraud, provide customer support, comply with law, protect rights or perform other permitted business purposes.

AYKA may share relevant information with payment gateways, payment aggregators, checkout providers and payment service providers, including providers such as GoKwik where applicable.

Such sharing may be necessary for payment processing, transaction processing, COD verification, fraud prevention, payment reconciliation, refunds, customer verification, transaction communication and related services.

The applicable payment or checkout provider may independently process information under its own privacy policy, terms and applicable legal and regulatory requirements.

17. WEBSITE AND TECHNOLOGY PROVIDERS

AYKA may use third-party technology providers that assist with Website hosting, infrastructure, Shopify services, analytics, customer support, communication, security, databases, cloud services, checkout technology and other operational functions.

These providers may process relevant personal information on AYKA's behalf or independently where applicable. AYKA may take reasonable contractual, technical or organisational measures appropriate to the circumstances to protect personal information processed through such providers.

18. LOGISTICS AND DELIVERY PARTNERS

AYKA may share information reasonably required to fulfil and deliver your order with logistics and delivery partners. Such information may include your name, phone number, shipping address, PIN code, order details, package details and delivery-related information.

The information is shared for purposes including shipment creation, pickup, transportation, delivery, delivery communication, address verification, shipment tracking, returns and reverse logistics.

19. MARKETING AND ANALYTICS PROVIDERS

Where permitted by applicable law, AYKA may provide or permit access to relevant information to advertising, analytics and marketing service providers for campaign measurement, conversion tracking, audience measurement, remarketing, advertising optimisation, customer acquisition, Website analytics and marketing performance analysis.

Such providers may independently process information in accordance with their own privacy policies and applicable law. Where applicable law requires consent for a particular marketing or advertising activity, AYKA will obtain the required consent or provide an applicable opt-out mechanism.

20. CUSTOMER SUPPORT AND COMMUNICATION PROVIDERS

AYKA may share relevant information with service providers that assist with customer support, email, SMS, WhatsApp or other communications, order management, ticketing, customer relationship management and related business functions.

Communications may be stored or processed where reasonably necessary to provide customer service, investigate complaints, resolve disputes, maintain records, prevent fraud, comply with law or protect AYKA's legitimate interests.

Any successor entity or recipient of such information may be required to process the information in accordance with applicable legal requirements.

23. WE DO NOT SELL PERSONAL DATA FOR MONEY

AYKA does not sell personal data to third parties for monetary consideration as a standalone data-selling business.

However, AYKA may share relevant personal information with authorised payment providers, checkout providers, logistics partners, technology providers, analytics providers, advertising providers, marketing providers and other service providers where permitted by applicable law and reasonably necessary for the purposes described in this Privacy Policy.

Such sharing may include information used for advertising measurement, attribution, analytics, remarketing, fraud prevention, transaction processing and other legitimate business purposes.

Such providers may include Shopify, GoKwik, payment gateways, payment aggregators, acquiring banks, logistics providers, analytics providers, advertising platforms, communication providers, customer support providers, hosting providers, cloud providers and other operational service providers.

Where you interact directly with a third-party service, that third party's own terms and privacy policy may also apply. 25. INTERNATIONAL DATA PROCESSING

Some service providers used by AYKA may store or process personal information on infrastructure or servers located outside India. Where personal information is processed outside India, AYKA will take such measures as are required under applicable law and applicable contractual or technical arrangements.

International processing may occur where necessary to operate the Website, payment and checkout services, technology systems, analytics, advertising, communications, cloud infrastructure or other business functions.

International processing does not remove or reduce AYKA's obligations under applicable Indian law.

26. DATA RETENTION

AYKA does not retain personal information indefinitely without a legitimate or lawful purpose. Personal information may be retained for as long as reasonably necessary to process and fulfil orders, provide customer support, maintain customer accounts, administer returns and exchanges, process cancellations and refunds, administer warranties, reconcile payments, maintain accounting and tax records, comply with GST requirements, prevent fraud, maintain security, resolve disputes, enforce agreements, establish or defend legal claims and comply with other legal or regulatory obligations.

Certain transaction, tax, accounting, payment, warranty, consumer protection, fraud-prevention and legal records may need to be retained for longer periods where required or permitted by applicable law.

When personal information is no longer reasonably required, AYKA may delete, anonymise, aggregate or securely dispose of it, subject to applicable legal requirements and legitimate record-retention needs.

Deletion may not be possible where information must be retained to comply with law, prevent fraud, resolve disputes, maintain transaction records, establish or defend legal claims or satisfy another legally permitted purpose.

27. DATA SECURITY

AYKA takes reasonable technical and organisational measures appropriate to the nature of the information and the risks involved to protect personal information against unauthorised access, misuse, alteration, disclosure, loss, destruction, accidental or unlawful processing and other security risks.

Security measures may include access controls, authentication, restricted employee access, secure systems, monitoring, administrative controls, vendor controls, technical safeguards and other reasonable security practices appropriate to the circumstances.

Access to personal information may be limited to persons who require such access for legitimate business purposes.

However, no electronic transmission, storage system, internet connection, database or online service can be guaranteed to be completely secure. Accordingly, while AYKA takes reasonable security measures, AYKA does not guarantee absolute security of information transmitted or stored electronically.

28. DATA BREACHES AND SECURITY INCIDENTS

If AYKA becomes aware of a personal data breach or security incident affecting personal information, AYKA may take reasonable and legally required measures to investigate the incident, contain the incident, mitigate potential harm, restore affected systems, assess the information involved, preserve relevant evidence, take corrective measures and prevent recurrence.

Where applicable law requires notification to affected individuals, authorities, the Data Protection Board of India or another relevant authority or party, AYKA will make such notifications in accordance with applicable legal requirements.

AYKA may retain information where reasonably necessary for legal compliance, tax and accounting records, fraud prevention, dispute resolution, warranty administration, transaction records, legal claims, enforcement of agreements, regulatory requirements or other legally permitted purposes.

32. WITHDRAWAL OF CONSENT

Where processing is based on consent and applicable law permits withdrawal, you may withdraw consent by contacting AYKA or using the relevant opt-out mechanism provided by AYKA.

Withdrawal of consent will not affect processing that was lawfully carried out before withdrawal. AYKA may continue processing information where another lawful basis or legal requirement permits or requires such processing.
